A Federal High Court sitting in Ado-Ekiti has nullified the governorship primary election conducted by the Peoples Democratic Party (PDP) in Ekiti State ahead of the 2026 election.
The court also ordered the party to conduct a fresh governorship primary in strict compliance with the law and the party’s internal guidelines.
The presiding judge, Justice Babs Kuewumi, delivered the ruling on Tuesday in suit number FHC/AD/CS/29/2025, filed by a governorship aspirant, Funso Ayeni, against the PDP and the Independent National Electoral Commission (INEC).
Ayeni challenged the validity of the primary that produced Wole Oluyede, alleging that the party “failed to present a valid list of statutory and ad hoc delegates” used for the conduct of the election.
He argued that the failure to produce the authentic delegates’ list violated the PDP constitution and the Electoral Act, thereby rendering the primary invalid.
In his judgment, Justice Kuewumi held that the conduct of the primary did not comply with the provisions of the law and the party’s constitution.
Consequently, the judge nullified the primary election and ordered the PDP to conduct a fresh governorship primary in line with legal and party guidelines. He also directed INEC to monitor the exercise.
The court further ruled that all qualified aspirants must be allowed to participate in the fresh primary to ensure transparency, fairness, and internal democracy within the party.
